Terms & Conditions (Ontario)

Welcome to Mai Furniture. These Terms and Conditions (“Terms”) govern the use of our website, in-store purchases, and any related services. By accessing our site, placing an order, or making a purchase, you agree to comply with and be bound by these Terms, as well as our Privacy Policy, Shipping & Delivery Policy, and Return & Exchange Policy.

If you do not agree with any of these Terms, please do not use our website or services.

1. Definitions

  • “Mai,” “we,” “us,” “our” – refers to Mai Furniture.

  • “Customer,” “you,” “your” – refers to the individual or entity purchasing Goods or using our Services.

  • “Goods” – refers to furniture, mattresses, décor, and any other products sold by Mai.

  • “Services” – includes delivery, assembly, installation, and related services.

  • “Contract” – refers to the binding agreement between you and Mai Furniture by TeleTime formed when an order is accepted.

“Applicable Law” – means the laws of the Province of Ontario and the federal laws of Canada that apply.

2. Orders & Contract Formation

  1. Placing an Order

    • Orders may be placed online, by phone, or in-store. When you place an order, you are offering to purchase the selected Goods under these Terms.

    • All orders are subject to acceptance by Mai Furniture. An order confirmation (by email or in-person receipt) signifies acceptance and forms a binding Contract.

  2. Pricing & Payment

    • Prices are in Canadian dollars and exclude applicable HST (13%) and delivery or assembly charges, unless stated otherwise.

    • Mai reserves the right to correct any pricing errors prior to delivery.

    • Payment in full is required at time of purchase unless financing arrangements are approved in advance.

    • Accepted payment methods include major credit cards, debit, cash, and approved financing.

  3. Order Changes or Cancellations

    • Once an order is confirmed, it cannot be cancelled or modified without written approval from Mai Furniture.

    • Cancellations for non-custom products may be subject to restocking or administrative fees.

Custom or special-order items are non-cancellable and non-refundable once production begins.

3. Delivery, Risk & Ownership

  1. Delivery Scheduling

    • Delivery will be arranged based on product availability and your location, as outlined in our Shipping & Delivery Policy.

    • Customers must ensure that delivery routes are safe, accessible, and free of obstructions.

  2. Transfer of Risk & Title

    • Risk of loss or damage transfers to you upon delivery or pickup of the Goods.

    • Ownership (title) transfers only after full payment is received and processed.

  3. Failed or Refused Deliveries

    • If delivery cannot be completed due to inaccurate information, inaccessible premises, or customer absence, a re-delivery fee may apply.

Refused deliveries may also incur restocking fees and deductions for transportation costs.

4. Returns, Refunds & Exchanges

All returns and exchanges are handled in accordance with our Return & Exchange Policy, which forms part of these Terms.

Under Ontario’s Consumer Protection Act, customers are entitled to products that are:

  • As described and match samples or models shown

  • Of acceptable quality and durability

  • Fit for the purpose disclosed at time of sale

If a product is defective or not as represented, Mai will offer repair, replacement, or refund in line with consumer law. However, except where legally required, all sales are final and returns are subject to our discretion and policy conditions.

5. Product Warranty

  1. Manufacturer Warranty

    • Most products are covered by a manufacturer’s warranty against defects in materials or workmanship.

    • Warranty details vary by brand and product category.

  2. Mai Furniture Warranty Support

    • We will assist customers with submitting warranty claims to the manufacturer, provided the product was purchased from Mai and is still within the warranty period.

    • Warranty does not cover normal wear and tear, misuse, neglect, or damage caused by improper assembly, cleaning, or storage.

  3. Limitations

To the extent permitted by law, Mai’s liability for any defect is limited to the repair or replacement of the defective item or, at Mai’s option, a refund of the purchase price.

6. Limitation of Liability

  • Mai Furniture will not be responsible for indirect, incidental, or consequential damages, including loss of income, loss of enjoyment, or property damage.

  • Our total liability, whether arising in contract, tort, or otherwise, shall not exceed the purchase price of the product giving rise to the claim.

  • Nothing in these Terms limits your rights under Ontario’s Consumer Protection Act, which guarantees that consumers receive goods of acceptable quality and fitness.

7. Financing Terms

  • Financing, where available, is provided by third-party lenders.

  • All financing approvals, payments, and terms are governed by the lender’s agreement, not Mai Furniture.

Failure to make payments under financing agreements may result in repossession or additional fees in accordance with the lender’s policies.

8. Website & Intellectual Property

  1. All content, images, and materials on our website are the property of Mai Furniture or our licensors and are protected by copyright and trademark laws.

  2. You may use our site for personal, non-commercial purposes only. Copying, reproducing, or redistributing content without written consent is prohibited.

Prices, promotions, and availability displayed online are subject to change without notice.

9. Privacy & Communications

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information in compliance with Ontario and federal privacy laws. By providing your contact information, you consent to receiving communications regarding orders, deliveries, promotions, or account updates. You may unsubscribe from marketing communications at any time.

10. Force Majeure

Mai Furniture is not liable for delays or failures to perform due to events beyond our reasonable control, including but not limited to: weather conditions, natural disasters, strikes, transportation delays, or acts of government.

11. Dispute Resolution & Governing Law

  1. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

  2. In the event of a dispute, both parties agree to seek resolution through good faith negotiation.

  3. If unresolved, disputes shall be submitted to the courts of Ontario, and you consent to the exclusive jurisdiction of those courts.

Nothing in these Terms restricts your right to file a complaint under Ontario’s Consumer Protection Act or to seek assistance from the Consumer Protection Ontario agency.

12. Severability & Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force. Failure by Mai Furniture to enforce any right or term shall not constitute a waiver of such right.

13. Updates to These Terms

Mai Furniture reserves the right to update or revise these Terms at any time. The updated version will be posted on our website with the effective date noted above. Continued use of our website or services after such changes constitutes acceptance of the revised Terms.
